How Our Firm Works

Our network of attorneys, legal assistants, and scientific experts works around the clock to identify widespread harm caused by corporate wrongdoing. Case Investigation

Mass torts occur when a large number of people are injured by the same product. Mass torts are often handled as class actions or are consolidated in multidistrict litigation (MDL). In a class action lawsuit, all individual cases are combined into one large case. Each plaintiff becomes a member of the class. Any proceeds from a settlement or verdict are divided among the class members.

If the cases are transferred to MDL, they remain separate cases, but they are assigned to a single federal court and managed collectively. The parties will share related scientific evidence, and the judge will issue rulings that apply across cases, such as rulings on motions to dismiss or motions to discredit expert witnesses.

We will begin settlement negotiations when the responsible companies receive our demand letter. They will continue until we reach a fair and reasonable settlement or your case goes to trial. If the cases are consolidated as class actions or have been transferred to MDL, we will seek a global settlement.

We will not accept any offer that is lower than you deserve. If a settlement cannot be reached, the case will go to trial.

In an MDL, a few cases may go to trial to serve as test cases to guide the other settlements. The judge will then transfer the cases back to the original courts, and we will continue to negotiate a settlement or take your case to trial, depending on the outcome of the test cases that went to trial. In some cases, an MDL may result in a global settlement.
